All passengers are deemed to have accepted these terms and conditions.
1.1. These Passenger Carriage Rules apply to travel documents purchased through Marmaris Lines and to passenger carriage services provided in connection with such travel documents.
1.2. The passenger is required to read and review these rules before purchasing a travel document. Upon completion of the purchase, the passenger shall be deemed to have accepted the application of these rules, without prejudice to any mandatory provisions of applicable law.
1.3. The provisions contained herein shall not supersede mandatory provisions of applicable laws and regulations. Where mandatory legal provisions are required to apply, the relevant provisions of law shall prevail.
1.4. Where the entity selling the travel document and the carrier actually performing the carriage service are different, the carrier's own conditions of carriage may also apply to the relevant journey. The passenger is also required to comply with the specific conditions of the carrier communicated to the passenger at the time of purchase.
2.1. The travel document belongs to the passenger whose first and last name are stated on the document and, unless expressly stated otherwise, may not be transferred to another person.
2.2. The passenger's identification, passport and travel document details must correspond with one another. If the passenger uses a travel document issued with incorrect, incomplete or another person's information, the passenger shall, to the extent permitted by applicable law, be responsible for any consequences arising from the carriage service not being provided.
2.3. Where deemed necessary by the Seller or the Carrier for security and payment verification purposes, the passenger may be required to present information or documentation relating to the payment instrument used to purchase the travel document or to the verification of the payment transaction. Where the holder of the payment instrument is different from the passenger, the Seller may require that this situation be notified in advance.
2.4. Unless otherwise stated, open-date travel documents may be used within the calendar year in which they are issued, subject to the availability of the relevant carrier.
2.5. The travel document is valid only for the route and carriage service specified on the document.
2.6. Unless expressly stated otherwise, the price of the travel document covers only the passenger carriage service between the specified departure and arrival points. Additional services not included in the carriage fare may be charged separately.
3.1. The passenger must be present at the departure port at least 1 hour before the scheduled departure time.
3.2. The passenger is responsible for ensuring that passport, visa, travel document and other required document checks, check-in, baggage procedures, and border/customs formalities are completed on time.
3.3. If the passenger is unable to board the vessel because check-in procedures or passport and border controls conducted by the relevant authorities could not be completed on time, any claims arising from this situation shall be subject to the cancellation and refund terms set out herein and to applicable legislation.
3.4. Cancellation, modification or new booking requests made after the scheduled departure time will, as a general rule, not be processed, subject to the acceptance of the Carrier or Seller and the provisions of applicable law.
3.5. If the passenger is unable to travel because they are not present at the port on time or fail to complete the required procedures within the required time, this shall be considered a no-show/late arrival. In such cases, subject to applicable law and any mandatory rules of the Carrier, no refund or modification shall be provided for the travel document.
4.1. The passenger must comply with the safety and order rules onboard the vessel and with the instructions of the captain and vessel crew.
4.2. The passenger may not engage in any conduct that may endanger the safety of the vessel, vessel crew, other passengers or third parties.
4.3. If the passenger engages in conduct that endangers the safe operation of the vessel, prevents vessel crew from performing their duties, or seriously affects the safety or comfort of other passengers, the captain and vessel crew are authorized to take the necessary measures within the framework of applicable legislation and the vessel's safety procedures.
4.4. Passengers must comply with any safety instructions given to them during the vessel's departure and berthing manoeuvres and, where necessary, must remain seated.
4.5. In the event of damage or loss arising from the passenger's failure to comply with safety instructions, the liability of the Carrier and/or Seller shall be determined in accordance with applicable legislation.
5.1. Unless a specific seat number is expressly guaranteed on the travel document, no specific seat number is guaranteed onboard the vessel.
5.2. The vessel operator reserves the right to change the seating arrangements of passengers for safety or operational reasons.
6.1. Sailing times and schedules may be changed due to weather and sea conditions, port conditions, technical or operational reasons, decisions of official authorities, or other reasons beyond the Carrier's control.
6.2. In the event of a change to the sailing time or schedule, the passenger's applicable rights shall be determined in accordance with the relevant Carrier's rules and mandatory provisions of applicable legislation.
6.3. The Seller and/or Carrier may postpone, modify or cancel a sailing, or arrange an alternative sailing, due to safety, operational, weather or sea conditions, or instructions issued by competent authorities.
6.4. In the event of delays or cancellations caused by circumstances that do not arise from the Carrier's fault and that constitute force majeure or events beyond the Carrier's reasonable control under applicable law, the passenger's rights shall be determined in accordance with applicable legislation and the conditions of the relevant Carrier.
6.5. Unless the delay or change to the sailing is caused by the Carrier's fault or by a circumstance for which the Carrier is legally liable, the liability of the Seller or Carrier for additional accommodation, transportation, meals or similar expenses incurred separately by the passenger shall be assessed subject to applicable legislation.
7.1. The passenger is responsible for obtaining the passport, visa, residence permit, travel document and other official documents required for travel and for ensuring that such documents remain valid on the date of travel.
7.2. Visa and other entry requirements for Greece may vary depending on the passenger's nationality, type of passport and the rules applicable at the time of travel by Greece, the Schengen Area and the relevant official authorities.
7.3. Visa requirements or exemptions applicable to holders of Turkish Special (Green) or Service (Grey) Passports are subject to the official rules in force on the date of travel. The passenger is responsible for checking the current official entry requirements applicable to their individual circumstances before travelling.
7.4. Holders of ordinary Turkish (Burgundy) passports are responsible for having a valid visa and other travel documents required for entry into Greece and the Schengen Area on the date of travel.
7.5. The final determination as to whether entry/exit stamps, visas, permits or other records contained in the passenger's passport or travel documents constitute an obstacle to travel shall rest with the relevant border and official authorities.
7.6. The passenger's inability to travel due to failure to satisfy visa, passport, travel document or other official requirements shall not, by itself, constitute a failure by the Seller or Carrier to perform the sailing.
7.7. If the competent authorities refuse to allow the passenger to board the vessel or enter the country, the applicable cancellation, refund and modification conditions shall be determined within the framework of the “Cancellation and Refund Terms” set out below and applicable legislation.
8.1. Pregnant passengers must comply with the Carrier's current conditions of carriage and safety rules regarding their health condition and stage of pregnancy.
8.2. If a medical report or doctor's approval is required under the Carrier's safety rules, the passenger is required to provide the relevant document.
8.3. Where the journey may pose a particular risk to the passenger due to their age, health condition or physical condition, the Carrier may, for safety reasons and within the framework of applicable legislation, determine the conditions of carriage or take the necessary precautions.
8.4. These provisions shall not be interpreted as eliminating the responsibilities of the Seller or Carrier arising from mandatory provisions of applicable law.
9.1. The passenger is responsible for ensuring that their baggage complies with the baggage rules in force during carriage.
9.2. Valuables such as cash, jewellery, precious metals, valuable documents, documents of high commercial value, passports and other important documents must be kept safely by the passenger with due care.
9.3. Liability concerning baggage or personal belongings shall be determined within the framework of the Turkish Commercial Code, applicable international conventions and other mandatory provisions of applicable law.
9.4. Liabilities that may be imposed on the Seller or Carrier under mandatory legislation may not be excluded by this provision.
10.1. The liability of the Seller and Carrier for the death or injury of a passenger, or for the loss of or damage to baggage, shall be determined in accordance with applicable Turkish legislation and, where applicable, relevant international conventions.
10.2. In the event of damage caused by the passenger's own fault, negligence or unlawful conduct, the effect of the passenger's fault on liability shall be taken into consideration in accordance with applicable legislation.
10.3. Where the Seller or Carrier is not legally liable, the Seller or Carrier shall not be held responsible for damage arising from the passenger's own fault or from events beyond the Seller's or Carrier's control.
10.4. No provision of these terms shall be interpreted as excluding any liability of the Seller or Carrier that cannot legally be excluded.
11.1. The sale price of the travel document shall be determined based on the price displayed to the passenger at the time of purchase.
11.2. If the fare is charged in a currency different from the currency in which the fare was advertised, the applicable exchange rate and payment amount shall be determined in accordance with the conditions displayed to the passenger at the time of purchase.
11.3. Where taxes, port charges, service fees or other charges are separately specified at the time of purchase, their nature and refund conditions shall be communicated to the passenger at the time of purchase.
12.1. Passenger carriage services are outside the scope of the Regulation on Distance Contracts pursuant to Article 2, paragraph 2(h) thereof, subject to the information obligations specified in the Regulation.
12.2. Accordingly, the general 14-day right of withdrawal does not apply to passenger carriage services to be performed on a specific date or during a specific period within the scope of the Regulation on Distance Contracts.
12.3. The absence of a right of withdrawal does not eliminate the contractual cancellation, refund and modification terms set out in the following provisions. Passengers shall refer to the following provisions when making cancellation or refund requests.
13.1. For cancellations requested by the passenger, the date and time on which the cancellation request is actually received by the Seller shall be taken as the basis for determining the passenger's entitlement to a refund and the applicable refund percentage.
13.2. The date or time on which the passenger sends the cancellation request shall not be decisive; the date and time on which the request reaches one of the Seller's official communication channels shall be taken as the basis.
13.3. The following refund rates shall apply to cancellation requests made by the passenger:

13.4. The refund rates shall be applied to the carriage fare that was communicated to the passenger at the time of purchase and that is eligible for a refund. Separately purchased services, services provided by third parties, or fees collected by official authorities shall be subject to the refund conditions of the relevant service and applicable legislation.
13.5. Where a refund is due, the refund shall, to the extent reasonably possible, be processed using the same payment method through which the payment was made.
13.6. The scheduled departure date and time stated on the travel document shall be used when calculating the applicable cancellation period.
14.1. A change to the date or time stated on the travel document may be made if requested at least 48 hours before departure, subject to availability on the relevant sailing.
14.2. Changes to the date or time are subject to the Carrier's availability, and the Seller does not guarantee that a new place will be available.
14.3. If the price of the new travel date or sailing is higher than the existing travel document, the difference in price shall be collected from the passenger.
14.4. If a lower-priced sailing is selected, any applicable fare difference shall be assessed in accordance with the pricing and refund rules of the relevant Carrier and Seller.
14.5. A date or time change request is a transaction separate from a cancellation request and may not be used as a means of cancelling the travel document at the last minute and creating a new reservation.
14.6. Where the relevant Carrier has a more specific or different modification policy, the Carrier's conditions communicated to the passenger at the time of purchase may apply.
15.1. Applying for a visa, refusal of a visa application, delayed issuance of a visa, failure to receive a visa before the travel date, or failure to obtain other official documents required for travel on time shall not, by itself, give rise to an additional right to a refund.
15.2. In such cases, the passenger's cancellation request shall be subject to the cancellation and refund conditions set out in Article 13, based on the date and time the cancellation request is received by the Seller.
15.3. Where travel is not possible due to a missing visa or official travel document, any applicable refund entitlement shall remain reserved if the passenger submits a cancellation request within the applicable cancellation period before the travel date.
15.4. If the passenger decides not to travel at the last minute due to a missing visa or travel document, the request shall be assessed according to the periods specified in Article 13.
15.5. These provisions do not provide for a different cancellation policy for passengers purchasing travel documents for visa application purposes compared with other passengers. The same cancellation and refund conditions shall apply equally to all passengers.
16.1. If competent authorities refuse to allow a passenger to board the vessel or enter the destination country because the passenger has failed to satisfy passport, visa, travel document, entry or other official requirements, the applicable refund and modification conditions shall be determined in accordance with Articles 13 and 14 and applicable legislation.
16.2. Travel restrictions arising from the passenger's personal documentation or permit status shall not be considered a failure by the Seller or Carrier to operate the sailing.
17.1. If the passenger does not participate in the journey at the departure date and time stated on the travel document and has not previously submitted a valid cancellation or modification request, the ticket shall be considered a no-show.
17.2. In the event of a no-show, subject to applicable legislation and any mandatory rules of the Carrier, no refund or date/time change shall be provided for the travel document.
17.3. Cancellation, refund or date/time change requests made after the vessel has departed shall not be processed.
18.1. If a sailing is cancelled, postponed or materially changed by the Seller or Carrier, the passenger's rights shall be determined according to the reason for the event and applicable legislation.
18.2. Cancellations resulting from the Carrier's own fault shall not be treated in the same manner as cancellations caused by adverse weather conditions, decisions of official authorities, security reasons or events beyond the Carrier's reasonable control.
18.3. This provision shall not be interpreted as limiting any rights of the passenger arising from mandatory provisions of applicable law.
19.1. Sailings may be postponed, modified or cancelled due to adverse weather and sea conditions, closure of ports, decisions of official authorities, security threats, natural disasters, war, terrorist incidents, civil disturbances, strikes, technical or operational requirements, or other events occurring beyond the Carrier's reasonable control.
19.2. In such circumstances, the passenger's rights shall be determined according to the nature of the event, the conditions of the relevant Carrier and mandatory provisions of applicable legislation.
19.3. Whether accommodation, transportation, meals or other personal expenses separately incurred by the passenger will be covered by the Seller or Carrier shall be assessed in accordance with applicable legislation and the legal nature of the event.
20.1. These terms shall be governed by Turkish law, without prejudice to applicable international conventions and mandatory provisions of law.
20.2. The rights of passengers acting in the capacity of consumers to apply to the Consumer Arbitration Committee and Consumer Court, as provided under applicable legislation, are reserved.
20.3. In consumer disputes, the competent authority and court shall be determined according to the jurisdictional rules provided under the applicable consumer legislation.
20.4. For parties who are not consumers, the applicable rules regarding jurisdiction and competence shall apply within the framework of applicable legislation.
21.1. If any provision of these rules is determined by a competent authority or court to be invalid, void or unenforceable, this shall not affect the validity of the remaining provisions.
21.2. No provision of these rules shall be interpreted as eliminating or reducing any rights legally granted to consumers that cannot be restricted by contract.
21.3. In consumer contracts, where any provision is unclear or capable of more than one interpretation, the relevant provisions of applicable consumer legislation shall apply.
22.1. The passenger acknowledges that, before purchasing the travel document, they have had the opportunity to read, review and access these Passenger Carriage Rules and the Cancellation, Refund and Modification Terms.
22.2. Upon purchasing the travel document, the passenger shall be deemed to have accepted these rules, without prejudice to mandatory provisions of applicable law.
22.3. The cancellation and refund terms shall be presented to the passenger in a clear, understandable and easily accessible manner before the purchase is completed.
22.4. Cancellation and modification requests submitted by the passenger shall be assessed in accordance with the periods and conditions specified in these rules.
